By the end of this month, January 26, 2012, within the next seven days, Presbo is to have to answer a subpeona to appear in federal court to answer a multi-state lawsuit to the effect that he has yet to prove that he is elligible to be on the ballot in November.
His dream legal team is arguing, here at the last minute, that the states have no authority to determine who is and isn’t eligible. Pretty much that in the formation of this country, when the independent states got together and formed a federation and delegated certain duties to the central government to perform, that they permanently and totally lost any ability to then see that those delegated duties were actually done. Presbo is arguing that all of the other folks involved in the election process, like the electoral college and the subsequent confirmation of the election by Congress make any state’s concerns irrelevant.
Much like the movie, Seven Days in May, this is being spun as something to be viewed as a radical partisan faction that is trying to overthrow the president because they disagree with his politics. Nothing to do with state’s rights, the 10th amendment, or the possible validity of any birther claims.
To paraphase the Labyrinth “Through debt untold and politicians unnumbered, we have fought our way here to the court beyond the capital city to take back the republic that you have stolen, for our will is as strong as yours, and our kingdom is as great. You have no power over us.
